Ludus Gym Expectations

In order to get the most out of working with each other I feel it’s important to set some ground rules. I’ve outlined below the key roles and responsibilities . AND clearly stated what I expect from you as a member of Ludus Gym. Please read this document carefully before signing. And, if there is anything you disagree with, or feel uncertain about please let me know immediately.

We Must…

1. We must build you a customized fitness plan so that you are crystal clear on what to focus on and how to achieve your goal.

2. We must educate you about all areas involving exercise, recovery and nutrition.

3. We must provide you with world class support so that you are never more than 24-hours away from the answers you need to move forward.

4. We must hold you to a higher standard than you hold yourself, give you critical feedback and keep you accountable via our world class coaching frameworks.

5. We must mentally prepare you for radical personal transformation. This means telling you what you need to hear NOT what you want to hear.

6. We must connect you with new friends and like minded people that want to see you achieve your goals.

7. We must monitor our world class community to ensure a friendly and inspiring environment.

8. We must bring out your best, even if it means revealing uncomfortable truths about your personal standards and habits.

9. We must apologize if we ever let you down, and do our best to make it right.

10. We must not let you off. Because if we let you off, we let you down.

You Must…

1. You must be quick to implement.

   
   

2. You Must be quick to ask for help. Do not suffer in silence.

3. You must be quick to share your wins and lessons.

4. You must pay your membership fees in full and on time.

5. You must stay committed to the program. We want to you to be part of the community for a very long time. Our average member stays with us for a minimum of 2 years. We aim to maintain that relationship + more with you.

6. You must make use of all the resources available to you. This includes Accountability coaches, Classes, 24/7 support network, community events.

7. You must think twice, ask once. The better quality your questions the better quality our answers.

8. You must be prepared for radical transformation, regardless of how ready you feel.

9. You must be open to critical feedback. Every piece of feedback we give you is designed to help you achieve your goal.

10. You must be respectful towards other members and the Ludus Coaches.

11. You must be open to helping other community members succeed.

12. You must uphold the standards within our world class community and represent the Ludus brand with professionalism and a high level of integrity.

I confirm that there is no reason a doctor has advised that I don't perform physical exercise.

Has  your  doctor  ever  said  that  you  have  a  heart  condition  and  that  you  should  only  do  physical  activity recommended by a doctor?

Do you feel pain in your chest when you do physical activity?

In the past month, have you had chest pain when you were not doing physical activity?

Do you lose your balance because of dizziness or do you ever lose consciousness?

Do you have a bone or joint problem (for example, back, knee or hip) that could be made worse by a change in your physical activity?

Is your doctor currently prescribing drugs (for example, water pills) for your blood pressure or heart condition?

Do you know of any other reason why you should not do physical activity?

I understand it is my responsibility if i answered yes to any of the above questions to inform my doctor of my wish to increase my exercise levels. Talk with your doctor by phone or in person BEFORE you start becoming much more physically active.

You may be able to do any activity you want - as long as you start slowly and build up gradually.

Or, you may need to restrict your activities to those which are safe for you. Talk with your doctor about the kinds of activities you wish to participate in and follow his/her advice.

Find out which programs are safe and helpful for you.

Release of Liability

1) In consideration of being allowed to participate in the activities and programs of Ludus Gym and to use its facilities, equipment and machinery in addition to the payment of any fee or charge and subject only to the statutory rights and implied warranties which cannot be excluded, I do hereby waive, release and forever discharge Ludus Gym and it’s officers, affiliates, subsidiaries, agents, employees, representatives, executors and all others (Ludus Gym) from any and all responsibilities or liabilities from injuries or damages arising out of or connected with my attendance at Ludus Gym, with the exception of any liability for death or personal injury arising from the negligence of Ludus Gym representatives, my participation in all activities, my use of equipment or machinery, or any act of omission. 

2) I understand and am aware that strength training, flexibility and aerobic exercise, including the use of equipment, are a potentially hazardous activity. I also understand that fitness activities involve a risk of injury and even death, and that I am voluntarily participating in these activities and using equipment and machinery with knowledge of the dangers involved. Subject only to the statutory rights and implied warranties, which cannot be excluded, I hereby agree to expressly assume and accept any and all risks of

injury or death in respect of myself and caused directly by me or as a result of my conduct, omissions or negligence to others. I hereby further agree to expressly assume all responsibility for any injury or death caused directly or indirectly through my conduct, omissions or negligence to any third person (including Ludus Gym representatives) through my attendance at Ludus Gym and any premises owned, operated, controlled and/or leased by Ludus Gym representatives. 

3) I do hereby further declare myself to be physically sound and suffering from no condition, impairment, disease, infirmity, or other illness that would prevent my participation or use of equipment or machinery and the Ludus Gym facility. I do hereby acknowledge that I have been informed of the need for a medical practitioner’s approval for my participation in an exercise fitness activity or in the use of exercise equipment and machinery. I also acknowledge that it has been recommended that I have a yearly or more

frequent physical examination and consultation with my physician as to physical activity, exercise and use of exercise and training equipment so that I might have his /her recommendations concerning these fitness activities and equipment use. I acknowledge that I have either had a physical examination and been given my medical practitioner’s permission to participate, or that I have decided to participate in activities and use of equipment and machinery without the approval of my physician and do hereby

assume, subject only to the statutory rights and implied warranties which cannot be excluded, all responsibility for my participation, activities and utilization of equipment and machinery in my activities.

Agreement

To fully experience and gain the most benefit from Ludus Gym, you agree to the following:

Section 1:

Program Guidelines,

Payment Terms Program: 8 Week Challenge

Investment: £749 upfront (for the first 8 weeks) into £199 per month until cancelled (30 day notice period)

Payment Terms You hereby authorize Ludus Gym to collect the Program cost outlined above through successive monthly payments with the first payment being due on the date of enrolment in the Program and all subsequent payments being due monthly after the previous payment. Payments are due in full on the due date.

● If payment fails, Client must remedy this situation and provide a valid form of payment within five (5) calendar days or Client may be removed from the Program.

● Payments may be made via credit or debit card, bank transfer, wire transfer, or through PayPal. - No payments will be refunded at any time for any reason. For all credit or debit card payments:

● You hereby consent to having these charges automatically charged to your credit or debit card on the due date.

● Ludus Gym is authorized to collect the payment due (in full) by collecting on any/all credit or debit cards that are provided to Ludus Gym by the client.

● The client may determine which payment method is preferred and the client is responsible for informing Ludus gym of this preference at least two (2) business days prior to the payment due date since Ludus gym payment system may automatically charge one of the cards on file that may not be the client’s preferred payment method

Section 2.

Privacy Policy

You agree that your participation is subject to Ludus gyms Privacy Policy (as found on the website below) and that you agree to adhere to all terms as outlined on these websites. While we do not anticipate making frequent edits, Ludus reserves the right to make modifications to this policy at its sole discretion and without notifying Program participants.

Section 3.

Terms of Sale

(a) You hereby agree that all Program sales are final, non-refundable, and non-transferrable

(b) You agree to make all payments on time and in full as outlined in Section 1

(c) You agree that you have fully consented to any payment to Ludus gym and that any/all payments are valid and that you have consented to the purchase of the Program as outlined in Section 1.

(d) You agree to waive any/all rights to charge-back, dispute, or make claims (“disputes”) against any payment made to Ludus Gym as being fraudulent, purchased in error, services not delivered to you, product not received, or any other dispute which claims that any payment is unlawful. (e) You agree to not initiate any disputes or claims through your credit card company, bank, lending institution, or any other payment provider since you have fully consented to all charges outlined in Section 1 and thus you agree that you may not dispute any payments made to Ludus Gym for the Program.

Section 4.

Right to Use Name & Likeness

(a) You hereby consent to the use of your name, photograph, likeness, voice, testimonial and biographical material, in whole or in part, for publication or reproduction in any medium, including but not limited to television, radio, print media and the internet, among others, for any purpose, including but not limited to public relations, education, advertising, marketing, training and research.

(b) Your consent is granted to Ludus and extends to such use without restriction or limitation as to time or geographic boundary.

(c) You hereby waive all rights you may have to any claims or demands for payment or royalties in connection with the use of any of such materials, regardless of the purpose of such use or publication, and regardless of whether a fee is charged or collected by Ludus for any product and/or service in connection with such use and publication.

(d) You also waive any right to inspect, review or approve any photograph, recording, or other written material at any time, and waive the right to approve the use and medium of publication determined by Ludus.

(e) You understand that Ludus owns all rights in and to any such photograph, recording or testimonial, including any copyright and/or trademark relating to such use.
